COURT-ORDERED LEGAL NOTICE

IF YOU BOUGHT CONCORDE AMERICA, INC. SECURITIES (CNDD.PK) BETWEEN JULY 23, 2004 AND AUGUST 11, 2004, AND/OR ABSOLUTE HEALTH, INC. SECURITIES (AHFI.PK) BETWEEN JUNE 8, 2004 AND DECEMBER 14, 2004 YOU MAY BE ENTITLED TO RECEIVE A PAYMENT FROM FUNDS RECOVERED.

On September 24, 2007, the Court approved a Distribution Plan to distribute disgorgement, prejudgment interest and civil penalty amounts received from Concorde America, Inc. (“Concorde”), Absolute Health, Inc. (“Absolute Health”), Donald E. Oehmke and Bryan Kos to proper claimants.   If you bought Concorde securities between July 23, 2004 and August 11, 2004, and/or Absolute Health securities between June 8, 2004 and December 14, 2004, you may be eligible to receive benefits from the Concorde Absolute Health Fund.  If you qualify, you may send in a Proof of Claim Form to obtain benefits.

How was the Concorde Absolute Health Fund created?
The Concorde Absolute Health Fund was created as a result of the Securities and Exchange Commission’s successful enforcement action against Concorde, Absolute Health, Donald E. Oehmke, Bryan Kos and certain Relief Defendants. The Commission’s action asserted that the Defendants willfully used schemes to defraud investors by promoting the two stocks by making untrue statements of operations and profitability and engaging in practices that artificially created demand for the respective stocks that would knowingly be fraud upon purchasers of the respective securities. The amounts recovered including interest have been deposited into the Concorde Absolute Health Fund and the Fund proceeds will be distributed to Eligible Claimants pursuant to the Distribution Plan.

Who is eligible for a recovery from the Concorde Absolute Health Fund?
The Potentially Eligible Claimants include all persons or entities that purchased shares of Concorde
(CNDD.PK)
Stock between July 23, 2004 and August 11, 2004 (Inclusive) and held Concorde shares at the end of the Concorde Fraud Period on August 11, 2004 and/or purchased shares of Absolute Health (AHFI.PK) Stock between June 8, 2004 and December 14, 2004 (Inclusive) and held Absolute Health shares at the end of the Absolute Health Fraud Period on December 14, 2004. You are not entitled to a recovery from the Fund with respect to any Concorde or Absolute Health shares that you acquired prior to the respective Fraud Periods.   In addition, to be eligible, you must have incurred an aggregate net loss from your combined purchases or sales of all Concorde and/or Absolute Health shares purchased during the respective Fraud Periods.

The Proof of Claim form package contains all of the information you need. You will find copies of the Proof of Claim form package and additional information about the Concorde Absolute Health Fund on the website www.ConcordeAbsoluteHealthFund.com.
